1. INTRODUCTION

Welcome to Health360. These Terms of Service (“Terms”) govern your use of the Health360 Platform (“Platform”) as a Medical Professional, Patient, or Healthcare Institution (Hospital, Clinic, Labs or Pharmacy). By registering for or using our services, you agree to abide by these Terms and comply with all applicable data protection laws, including but not limited to:

  • General Data Protection Regulation (GDPR)
  • Health Insurance Portability and Accountability Act (HIPAA)
  • Kenya Data Protection Act (for operations in Kenya)
  • Any other relevant national and international laws

If you do not agree to these Terms, you must not use Health360’s services.

2. DEFINITIONS

  • “Health360” refers to the digital healthcare platform operated by H360 Solution Ltd.
  • “User” refers to any Medical Professional, Patient, or Healthcare Institution using the Health360 Platform.
  • “Medical Professional” includes doctors, nurses, therapists, and other licensed healthcare providers.
  • “Healthcare Institution” refers to hospitals, clinics, pharmacies, and laboratories.
  • “Confidential Information” includes patient records, medical history, prescriptions, and all other sensitive data processed on Health360.

3. USER ELIGIBILITY & REGISTRATION

3.1 Medical Professionals

To use Health360 as a healthcare provider, you must:

  • Be a licensed medical professional in your country of operation.
  • Provide valid registration and professional licensing details.
  • Comply with professional ethics, confidentiality obligations, and telemedicine regulations.

3.2 Patients

To use Health360 as a patient, you must:

  • Be at least 18 years old or have parental/guardian consent if under 18.
  • Provide accurate personal and medical history for effective diagnosis and treatment.

3.3 Healthcare Institutions

To use Health360 as a hospital, clinic, lab or pharmacy, you must:

  • Be a legally registered medical institution with government-approved licenses.
  • Ensure that all medical personnel using the platform are authorized professionals.
  • Comply with data security and patient confidentiality requirements.

4. DATA PRIVACY & PROTECTION

4.1 Collection & Use of Data

  • Health360 only collects and processes necessary personal and medical data for healthcare delivery.
  • All data is securely encrypted and stored following HIPAA and GDPR guidelines.
  • Users have the right to access, modify, or delete their personal data upon request.

4.2 Confidentiality Obligations

  • Medical Professionals & Healthcare Institutions must maintain strict confidentiality regarding patient data.
  • Health360 does not share personal data with third parties without explicit user consent, except where legally required.

4.3 Data Security Measures

  • Health360 implements end-to-end encryption, multi-factor authentication, and data anonymization to prevent unauthorized access.
  • Unauthorized data breaches must be reported immediately to Health360’s Data Protection Officer.

5. USER RESPONSIBILITIES

5.1 Medical Professionals

By using Health360, you agree to:

  • Provide accurate diagnoses and prescriptions within your licensed scope.
  • Use the platform only for professional medical consultations.
  • Not store, download, or share patient information outside the platform.
  • Maintain ethical and professional behavior in all consultations.

5.2 Patients

By using Health360, you agree to:

  • Provide truthful medical history and symptoms for accurate treatment.
  • Follow medical advice given through the platform responsibly.
  • Not misuse or manipulate consultations for non-medical purposes.

5.3 Healthcare Institutions

By using Health360, you agree to:

  • Ensure that all staff using the platform comply with confidentiality policies.
  • Regularly update patient records and ensure compliance with national medical regulations.

6. PAYMENT & SERVICE FEES

  • Health360 services may be subject to consultation fees, subscription plans, or transaction charges, depending on the service used.
  • Payment processing will be done via secure payment gateways.
  • Refunds, where applicable, will be processed under Health360’s refund policy.

7. LIABILITY & DISCLAIMERS

  • Health360 is a technology platform facilitating telemedicine consultations; it does not replace in-person medical examinations where required.
  • Health360 does not assume liability for misdiagnosis, inaccurate prescriptions, or any medical malpractice arising from professional-user interactions.
  • Health360 reserves the right to suspend or terminate access for users who violate these Terms.

8. TERMINATION & SUSPENSION OF SERVICES

8.1 Grounds for Termination

Health360 reserves the right to terminate user accounts for:

  • Violation of data privacy laws or unauthorized data access.
  • Unethical medical practice or misconduct by healthcare professionals.
  • Fraudulent patient activity or false medical claims.
  • Non-compliance with national healthcare laws.

8.2 Termination Process

  • A formal warning will be issued before termination, except in severe breaches.
  • Users may appeal suspensions via Health360’s Compliance Team.

9. GOVERNING LAW & DISPUTE RESOLUTION

  • These Terms shall be governed by the laws of [Jurisdiction].
  • Any disputes shall first be resolved through negotiation and mediation.
